INDIRESH ORAL ORDER This petition is filed by the petitioner under Section 11(5) of the Arbitration and Conciliation Act, 1996, seeking appointment of sole Arbitrator for adjudication of disputes that have been arisen between the petitioner and respondents in terms of Clause 14 of the Memorandum of Agreement dated 08th September, 2017 (Annexure-A). - 3 - HC-KAR NC: 2025:KHC:49776 CMP NO.45 OF 2025 2. Heard Sri. Joseph Anthony, learned counsel appearing for the petitioner and Sri. Vishwas Gowda G.M., learned counsel appearing for respondents. 3. Having taken note of the submission made by learned counsel appearing for the parties and on perusal of the Arbitration Notice dated 02nd August, 2024 (Annexure-G), I am of the view that, appointment of former judge of this Court as Arbitrator is necessary in this petition to resolve the dispute between the parties. 4. Therefore, Hon'ble Sri. Justice Ramachandra D. Huddar, former judge of this Court is appointed to act as a Sole Arbitrator in the Arbitration and Conciliation Centre (Domestic & International), Bengaluru as per the extent Rules. In order to avoid further delay in the matter, parties are directed to appear before the Arbitration and Conciliation Centre (Domestic and International), Bengaluru on 06th January, 2026 at 11.00 a.m. 5.
