Neutral Citation No. - 2025:AHC:24019 Court No. - 49 Case :- WRIT - B No. - 111 of 2025 Petitioner :- Ram Kripal And 2 Others Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Maha Prasad,Rajjan Verma Counsel for Respondent :- Achal Singh,C.S.C. Hon'ble J.J. Munir,J. Heard Mr. Maha Prasad, learned counsel for the petitioners in support of the motion to admit this petition at considerable length, Mr. Achal Singh, learned counsel appearing on behalf of respondent no. 5 and Mr. Sharad Chandra Singh, learned Additional Chief Standing Counsel appearing on behalf of the State. The petitioners are hardly affected by the order impugned in the sense that the objections were filed by respondent no. 6, Namesh, which were rejected as not maintainable. An appeal was carried by respondent no. 6 to the Settlement Officer of Consolidation, which too has been held barred by time and not maintainable and, therefore, dismissed. A revision, then, was preferred by respondent no. 6 which has been allowed by the order impugned remanding the cause to the Consolidation Officer with a direction to determine the title objections in accordance with law after hearing all parties within six months. No rights of the petitioners were ever crystalized under the orders of the Consolidation Officer or the Settlement Officer of Consolidation which the Deputy Director of Consolidation might have disturbed. In this view of the matter, no case for interference with the impugned order, which is an order of open remand, plain and
simple, is made out. The petitioners would have all opportunity to suit his case before the Consolidation Officer. Subject to the above remark, this petition fails and is summarily dismissed.
