ORAL ORDER Petitioner arrayed as accused No.1 in Crime No.54/2025 of Adugodi police station, registered for the offence punishable under Sections 8(c) 21(c), 22(c) of the Narcotic Drugs And Psychotropic Substances, Act, 1985(for short ‘NDPS Act’) is before this Court in this petition under Section 483 of BNSS, 2023 praying to enlarge him on bail.
2. Learned HCGP has filed statement of objections. He would submit that the petitioner had approached the Sessions Court during crime stage and now charge sheet is filed.
3. Learned counsel for the petitioner has raised several
contentions including that the mandatory provisions contemplated under the BNSS, 2023 as well as under the NDPS Act are not followed etc,. He has however,

submitted that in view of filing charge sheet, the petitioner may be permitted to approach the Special Court, raising all contentions.
4. In light of the above submission, without observing any opinion on the merits of the case, reserving liberty to the petitioner to file a fresh petition before the Special Court raising all contentions, the petition is dismissed as withdrawn.
