1. Civil application No. 10606 of 2025 is filed seeking permission to withdraw the amount. Perused the application. Heard learned advocates for both sides. Considering the peculiar facts of the case and the reasons stated in the application, the applicants are permitted to withdraw the amount of interest on the amount of Rupees One Crore six Lakhs and some odd amount which stated to be already withdrawn, on furnishing usual undertaking to the 2025:BHC-AUG:31873
ca10606.25 -2- satisfaction of Registrar (Judicial) of this Court. Registry is directed to pay the said amount after calculation. The application is disposed of.
2. The civil application No. 310 of 2025 is filed for condonation of delay of 95 days caused in filing the first appeal.
3. Perused the application and heard learned advocates for both sides. Learned advocate for respondents strongly opposed the application. Considering the reasons stated in the application, it appears that the delay caused is not deliberate or intentional. Therefore, the application is allowed. The delay caused in filing the appeal is condoned in the interest of justice.
4. In first appeal, issue notice to the respondents, returnable on 17.12.2025.
