APARESH KUMAR SINGH =O=R=D=E=R= 23/04/2025 Petitioner is the defendant in T.S(P) No.31 of 2022 instituted by the respondent who is the sister of the present petitioner. She has challenged the order dated 31.05.2024 whereby the application for deciding a preliminary issue as to whether the claim of plaintiff is barred by law as appropriate remedy lay under the Indian Succession Act, 1925 has been dismissed by the learned Trial Court holding that the suit cannot be disposed of on this preliminary issue alone since it involves a mixed question of law and fact. However, after some argument, Mr. Soumendu Roy, learned counsel for the petitioner seeks permission to withdraw the present petition.
