1. The applicants, being legal representatives of the petitioner, have moved this application to bring their names on record and also to condone the delay caused in preferring the said application, for which learned counsel for the respondent objected.
2. Having considered the reasons disclosed in the application as well as the facts of the case, in my view, it would be appropriate to allow the application, subject to a cost of Rs. 2,000/- to be paid to the Advocates’ Association Bar Library, High Court, Aurangabad. If the delay is condoned, it would not cause prejudice to the rights of the respondent. On the contrary, if 1 / 2 2025:BHC-AUG:30488
910-CA-11960-25.odt the delay is not condoned and the applicants are not brought to record, then certainly their rights would be affected and they would suffer irreparable loss.
3. As a result, a civil application is allowed. The delay of 1346 days in filing the application to bring the legal representatives of the deceased petitioner on record is condoned, subject to a cost of Rs. 2,000/- (Rupees Two Thousand). The applicants are directed to deposit the cost to the Advocates’ Association Bar Library, High Court, Aurangabad, within two weeks from today. Upon deposit of the cost, applicants are permitted to carry out the amendment to the petition and supply a copy of the amended appeal memo to the respondents within one week thereafter.
