Mr. Rajat Choudhry, learned Assistant Advocate General, appears and waives service of notice on behalf of the respondents. 2. With the consent of learned counsel for the parties, the matter is heard at this stage. 3. This writ petition has been filed for the grant of following substantive relief:- “i. That the respondents may be ordered to pay arrears to the petitioner in terms of notification/order Annexure P-2, from the due date with all benefits incidental thereof.” 1 Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 4. The case of the petitioner is that he had been conferred work charge status w.e.f. 01.01.2002, however, monetary benefits due to him on that count have not been released in his favour. Learned counsel for the parties have jointly submitted that the issue involved in the writ petition and the relief prayed for by the petitioner are now covered by the decision rendered by the Hon’ble Apex Court in The State of Himachal Pradesh & Ors. Versus Surajmani & Anr.2. Respondent-Irrigation & Public Health Department was also the appellant before the Hon’ble Supreme Court in some of the connected matters. Learned counsel for the parties also submit that this writ petition be disposed of in terms of the directions issued in the aforesaid decision. 5. In view of the fair stand taken by learned counsel for the parties and taking into consideration the aforesaid judgment, this writ petition is disposed of in light of the judgment passed by the Hon’ble Apex Court in the case of Surajmani2. Respondents are directed to implement the directions issued by the Hon’ble Supreme Court therein in case of the petitioner by taking all consequential actions within six weeks from today. 2 Civil Appeal No.1595 of 2025, decided alongwith connected civil appeals on 06.02.2025 3 The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
