1. Not on board, however, at the request of the parties, taken on board.
2. The parties to the present appeal are personally present before this panel and have filed compromise pursis. It is taken on record and marked Exhibit 'X' for identification. 2025:BHC-AUG:36387

3. By the present appeal, the Appellant/Ori. Claimant prayed for enhancement of compensation which was granted by the judgment and award dated 30.04.2019 passed in M.A.C.P. No.776/2013 by the Member, M.A.C.T., Aurangabad and had granted compensation of Rs.4,50,000/- with interest @ 9% from the date of filing of the petition till its realization.
4. The said amount of compensation is already deposited by the Respondent No.3/Insurance Company with interest and the same has already been withdrawn by the Claimant. During the pendency of present appeal, the Claimant and the Respondent/Insurance Company filed pursis Exhibit 'X'. As per the terms and conditions set out in the pursis, the Respondent No.3/Insurance Company agreed to pay additional amount of compensation of Rupees Four Lakhs only without any interest and the Claimant agreed to receive the same.
5. In view of above, the appeal is disposed of as per the terms of compromise pursis Exhibit 'X'.
6. Award be drawn accordingly within a period of eight weeks.
7. The Respondent No.3/Insurance Company shall deposit the additional amount of compensation before this Court. Thereafter, the Appellant/Claimant shall be entitled to withdraw the said amount on furnishing identity proof.
8. Civil Applications, if any, pending are also disposed of.
