Heard Sri Ashok Khare, learned Senior Counsel assisted by Sri Aditendra Singh, learned counsel for petitioners and Sri H.N. Mishra, learned counsel for respondent. It is not under much dispute that petitioners may be within the zone of consideration for promotion from the post of Accountant to the post of Assistant Manager(Accounts), and admittedly no D.P.C. is constituted after 2012. Learned Senior Counsel for petitioners submits that this is second round of litigation. The petitioners have approached earlier to this Court by way of filing a Writ-A No.6844 of 2024, which was disposed of with a direction that their grievance be considered. Learned Senior Counsel for petitioners also submits that in pursuance of above order, the Managing Director has passed an order dated 14.02.2025 and accepted the above facts that No DPC was constituted after 2012 and further states that process of promotion is under way and it is likely to be concluded within short period. Now Selection Committee has been constituted to finalize the promotion. Learned Senior Counsel for petitioners further submits that even thereafter till date meeting of Selection Committee has not taken place. Learned counsel for respondent on basis of limited instructions submits that if there is no legal impediment, the meeting of selection committee will take place before 15th August, 2025 in terms of G.O. dated 02.07.2025, which is part of writ petition. In the aforesaid circumstances, taking note that Selection Committee will call meeting within few weeks and promotion will be finalized before 15th August, 2025, therefore, this writ petition is disposed of with an observation that concerned respondent will comply the directions made in said G.O. dated 02.07.2025, so far as timeline is concerned and in case, petitioners constrain to approach this Court again for same grievance, it may be a reason to pass an adverse order against concerned respondents.
