Heard the learned Senior Counsel Mr. B.D. Konwar assisted by Mr. R. Saloi appearing for the petitioners as well as Mr.DP Goswami, the learned Public Prosecutor appearing for the State of Assam. 2. This is an application u/s 483 of the BNSS, 2023, whereby the petitioners, namely, 1. Himangshu Kakati, 2. Amulya Lahkar, 3. Anushmay @ Babu Kalita, 4. Moni Kakati, 5. Jatin Lahkar @ Biki, 6. Nitul Kalita @ Dhun, Gokul Kalita @ Bhakat & 8. Arup Kalita have prayed for releasing them on regular bail in connection with Rangia PS Case No. 351/2024. 3. On 25.12.2024, son (deceased) of the informant went out for picnic with his friends. There he was badly beaten up by his friends on an accusation that he has caused damage to a car. The informant being the father of the deceased was called to the place of occurrence. He was compelled to pay an amount of ₹7,000/- as damages. 4. Thereafter, the deceased was thrown into a pond. He, however, came out of the pond and dis-appeared.
Subsequently, his dead body was recovered in another place. 5. The post-mortem report shows that the deceased died because of head injuries. 6. The case diary shows that there are many witnesses, who saw the deceased was assaulted by his friends. But after that incident, he came out of the pond and ran away. The CD does not disclose as to who caused the head injuries to the deceased. 7. Mr. Goswami has objected to this bail application. 8. I have considered the submissions made by the learned counsel of both sides. 9. This Court is of the opinion that keeping the petitioners in judicial custody for further period of time would not serve any purpose. 10. For the aforesaid reasons, the petitioners no longer deserve to be detained in custody. Therefore, their bail application is allowed. 11. It is hereby directed that the petitioners, 1. Himangshu Kakati, 2. Amulya Lahkar, 3. Anushmay @ Babu Kalita, 4. Moni Kakati, 5. Jatin Lahkar @ Biki, 6. Nitul Kalita @
Page No.# 4/4 Dhun, Gokul Kalita @ Bhakat & 8. Arup Kalita, who were arrested in connection Rangia PS Case No. 351/2024, shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Rangia, Kamrup Assam. With the aforesaid direction, the bail application stands disposed of. The CD shall be returned. JUDGE Comparing Assistant
