Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 26.05.2025 Learned counsel for the petitioner has submitted that during the pendency of this bail application, a number of prosecution witnesses have been examined by the learned trial Court. In fact according to the learned counsel, 29 prosecution witnesses stand examined by the learned trial Court whereas at the time when earlier bail application filed by the petitioner was considered by the learned trial court, only 9 witnesses had been examined. In view of the above change in circumstances, it would be appropriate for the petitioner to approach the learned trial court by filing a fresh bail application. Accordingly the petition is disposed of with liberty to the petitioner to file a fresh bail application before the learned trial court. If and when such application is made before the learned trial Court, the same shall be considered on its own merits by the trial court without getting influenced by anything stated in the order of rejection of earlier bail application of the petitioner.
