HON’BLE THE CHIEF JUSTICE MR. APARESH KUMAR SINGH
Order 25/04/2025
Heard Mr. Tapash Datta Majumdar, learned senior counsel for the petitioners.
2.
By order dated 19.03.2025 passed in CRP No.02/2025, this Court had allowed the prayer for amendment of the plaint in the manner and to the extent indicated therein and directed the petitioners to incorporate the amendments in the plaint within two weeks subject to payment of cost of Rs.2,000/- in favour of the defendant.
3.
Mr. Majumdar, learned senior counsel for the petitioners, submits that the amended plaint could not be filed within the period of two weeks as the
learned counsel representing the plaintiffs was in personal difficulty. However, the learned Trial Court of Civil Judge (Sr. Division), Court No.2, Sepahijala, Sonamura has refused to grant extension of time to furnish the amended plaint as it was not within the jurisdiction of the learned Trial Court to extend the time limit fixed by this Court. Therefore, petitioners have approached this Court again in the present civil revision petition. Learned senior counsel for the petitioners further submits that the cost of Rs.2,000/- has already been paid to the defendant.
4.
Upon consideration of the submission of learned senior counsel for the petitioners and the narrow issue raised before this Court, this Court in exercise of its supervisory jurisdiction deems it proper to extend the time for filing the amended petition within 1(one) week from today.
5.
The instant petition is disposed of.
