JUSTICE LALITHA KANNEGANTI ORAL ORDER Aggrieved by the order passed in Crl.Misc.No.415/2022 dated 01.09.2022 by the II Additional Principal Judge, Family Court at Mysuru, the husband is before this Court. 2. It is submitted that the order is an ex-parte order and no opportunity was given to the petitioner and the Court had directed him to pay the amount of Rs.4,000/- per month to the wife and Rs.3000/- per month to the daughter. It is submitted that from the date of order, the petitioner is paying Rs.7000/- per month and it is stated that the petitioner is ready to take back his wife. It is submitted that neither the wife is coming forward to join him nor she is interested for the divorce. It is submitted that since the impugned order is an ex-parte order, the matter may be remanded and pending consideration of the same, he would continue to pay Rs.7000/- per month. - 3 - HC-KAR NC: 2025:KHC:28337 RPFC No. 116 of 2023 3. Though notice is served on the respondents. No vakalath is filed on behalf of the respondents. 4. Considering the submission of the learned counsel for the petitioner and the fact that he has already complied with the order passed by the Trial Court, this Court is passing the following order, ORDER i. The order dated 01.09.2022 passed in Crl.Misc.No.415/2022 by II Additional Principal Judge, Family Court at Mysuru is set aside and the matter is remanded to the Trial Court. ii. The petitioner shall continue to pay Rs.7000/- per month (Rs.4000+Rs.3000) to the respondents till the disposal of the petition. iii. Accordingly, the petition is disposed of.
