JUDGE, FAMILY COURT, MYSURU, DISMISSING THE PETITION FILED U/S 13(1) (ia) OF HINDU MARRIAGE ACT. THIS MISC.FIRST APPEAL PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER The appellant - husband and the respondent - wife along with their respective learned counsels are present. After prolonged negotiations, the appellant and the respondent have filed a joint memo. The respondent- wife has agreed to receive and the appellant - husband has agreed to pay a lump-sum of Rs.50,00,000/- [Rupees Fifty Lakhs only] in full and final settlement of the dispute. This is in addition to the other terms. The joint memo in its material part reads as under: "The appeal filed as against the Judgment and Decree dated 09.03.2020 in MC No.678/2018 on the file of the III Additional Prl. Family Judge, Mysuru has been settled between the parties on the following 3 terms and conditions and the Judgment and Decree may kindly be modified as under: 1. For a sum of Rs.50,00,000/- as permanent alimony for full and final settlement and the same shall be paid within 5 months from today in favour of The respondent Smt. Smitha. M by way of DD or RTGS. (a) The 1st installment of Rs. 10,00,000/- shall be paid within one month from today. (b) The remaining amount of Rs. 40,00,000/- shall be paid within five months from today. 2. The parties shall withdraw all the pending cases filed against each other. 3. The respondent has filed complaint which is registered and pending in CC No. 96/2025 before VII Addl. Senior Civil Judge (Sr. Dn.) and JMFC, Malalavadi, Jayanagar, Mysuru for the offences U/S 3(5), 351(3), 82(1) and 85 of BNS 2023 and U/S 3 of Dowry Prohibition Act 1961. 4. As per the above settlement arrived at between the parties, the respondent undertakes to co- operate for closure of the proceedings in CC 4 No.96/2025 before this Hon’ble Court. 5. Both the parties have accepted for the above conditions. If either of the parties are not complied the above conditions, they are at liberty to proceed with the appropriate legal actions including revival of the above cases. 6. Both the parties state that they have no claims whatsoever in nature the moveable [including valuable ornaments] or immovable property belonging to each other either existing or to be acquired in future on fulfillment of the above conditions. 7. Both the parties admit that they shall not interfere in the lives of each other in future. 8. In view of the aforesaid agreement entered into between the parties, the parties are agreed to dissolve the marriage solemnized on 08.08.2016 at Sara Conventional Hall, Dattagalli, Mysuru. The parties to this appeal have set their hands to this settlement before the Lok Adalat in the presence of conciliators on this 12.07.2025 at Bengaluru Bench. 5 This Miscellaneous First Appeal stands disposed of in terms of the joint memo calling upon the office to draw the decree in the afore terms.
