Neutral Citation No. - 2025:AHC:119010 Court No. - 81 Case :- TRANSFER APPLICATION (CRIMINAL) No. - 338 of 2025 Applicant :- Deepak Singh Patel Alias Guddu Opposite Party :- State of U.P. and Another Counsel for Applicant :- Satya Prakash Shukla Counsel for Opposite Party :- G.A. Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 of B.N.S.S. seeking transfer of Criminal Case No.782 of 2009, titled State Vs. Deepak Singh Patel @ Guddu, arising out of Case Crime No.215 of 2009, under Sections 41, 411, 414 IPC, Police Station Baburi, District Chandauli, pending in the court of Additional Civil Judge (Junior Division)/Judicial Magistrate, Chiakia, District Chandauli to competent courts of jurisdiction at Sonbhadra.
Learned counsel for the applicant submits that in respect of offence of theft relating to a tractor, a criminal case under Section 379 IPC etc. is pending at Sonbhadra, whereas the other case relating to receiving the stolen property is pending at Chandauli and the accused in both the cases is common. He prays that the case pending at Chandauli be transferred to Sonbhadra. During the course of hearing, it is not disputed that the cases were registered long back in the year 2008 and the stages of the two trials are also different, as in the trial at Chandauli courts, charge against the accsued has not framed so far. That apart, the offences are also different, therefore, this Court is not inclined to transfer the case. The application is dismissed.
