1. On the oral request made by learned counsel for the petitioners, the name of petitioner No.2 is ordered to be corrected as “Sukhdev Raj @ Rajesh Kumar S/o Chaman Lal” instead of “Sukhdev Raj” in the memo of parties. 2. The Registry of this Court is directed to carry out the necessary correction in the memo of parties in this regard. 3. The instant petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing of FIR No.0032 dated 15.03.2025 registered under Sections 115(2), 118(1), 351(3), 3(5) of BNS, 2023 (Annexure P-1) at Police Station City Balachaur, District SBS Nagar and all subsequent proceedings arising therefrom on the basis of compromise dated 07.04.2025 (Annexure P-2). 4. Vide order dated 01.07.2025, a Co-ordinate Bench of this Court had directed the parties to appear before the Illaqa Magistrate/trial Magistrate HEMLATA 2026.07.09 18:47 I attest to the accuracy and integrity of this document
CRM-M-31195-2025 -2- for getting their statements recorded with respect to the compromise dated 07.04.2025 (Annexure P-2). 5. Pursuant to aforesaid order, the parties have appeared before the Sub-Divisional Judicial Magistrate, Balachaur and got their statements recorded. Report dated 09.10.2025 has been received whereby after recording the statements of the parties, the Court below has shown its satisfaction that the compromise is genuine, voluntarily and without any pressure, coercion or un- due influence. 6. I have heard counsel for the parties and gone through the case file. 7. In the light of the satisfaction shown by the Court below and considering the offence for which the accused have been charged are not of serious nature, together with the fact that compromise will go a long way in ironing out the differences for betterment of future life of the parties and also in view of the law laid down in Gian Singh Vs. State of Punjab and another, 2012 (4) RCR (Criminal) 543 and Kulwinder Singh and others Vs.
State of Punjab 2007(3) RCR (Criminal) 1052, the present petition for quashing the FIR is allowed qua the petitioners. 8. Resultantly, FIR No.0032 dated 15.03.2025 registered under Sections 115(2), 118(1), 351(3), 3(5) of BNS, 2023 (Annexure P-1) at Police Station City Balachaur, District SBS Nagar and all subsequent proceedings arising therefrom on the basis of compromise dated 07.04.2025 (Annexure P-2) are hereby quashed qua the present petitioners.
