02 / 11.03.2025: It is the case of the petitioner that the petitioner was an Assistant Teacher and he has superannuated on 28.02.2007.
2. Petitioner claims that though he has been paid his pension, but his pension has not been revised considering the recommendation of the 7th PRC which is effected from 01.01.2016. He submits that the State has accepted the recommendation of the report of 7th PRC, thus, the petitioner is entitled for the relief as claimed and his pension should be accordingly modified and enhanced.
3. Mr. Mrinal Kanti Roy, learned counsel appearing for the State and Mr. Richa Sanchita, learned counsel appearing for the respondent submits that if the petitioner files representation before the Director of Primary Education, Government of Jharkhand, his grievance should
be looked into and appropriate order of recommendation will be passed as per law and if it is found that petitioner is entitled for any such relief, the same will be given effect to immediately.
4. Considering the submission, I direct the petitioner to file a representation before the Director of Primary Education, Government of Jharkhand within four weeks from today. On receipt of the same, the Director will take a decision and will pass an appropriate order within eight weeks thereafter. If it is found to the petitioner is entitled for any relief, recommendation will be made and forwarded to the Accountant General to do the needful from their end.
5. The entire process should be concluded within sixteen weeks from the date of receipt of the representation along with a copy of this
order.
6. Accordingly, the instant writ petition stands disposed with aforesaid direction.
