JUSTICE ASHOK S.KINAGI - 3 - HC-KAR NC: 2025:KHC:45499 WP No. 3524 of 2023 ORAL ORDER The petitioner filed this writ petition seeking for the following reliefs: (a) Issue appropriate writ, order or direction in the nature of certiorari quashing the Notification bearing No.R/UHSB/RECTT/ADVT.12/1327/2022- 23, dated 09.02.2023 insofar as inclusion of petitioner's name in the ineligible list for the post of Assistant Professor in Electrical and Electronics Engineering discipline issued by the first respondent vide Annexure-J. (b) Declaring that, insisting for qualification of Ph.D and NET/SET/SLET for the post of Assistant Professor in the Discipline of Engineering/Technology is illegal, void inoperative and the same is contrary to UGC Regulations on minimum qualification for appointment of Teachers and other academic staff in Universities and College and measures for the maintenance of standard in higher education, 2018. (c) Issue appropriate order or direction in the nature of mandamus, directing the Respondent to permit the Petitioner to attend the written examinations, which is scheduled to be held on 17.02.2023 for the post of Assistant Professor in the Department of Electrical and Electronic Engineering and consequently consider the - 4 - HC-KAR NC: 2025:KHC:45499 WP No. 3524 of 2023 case of the Petitioner for the appointment of the said post. (d) Grant any other reliefs as deemed fit by this Hon'ble Court in the facts and circumstances of the case including awarding of the cost, in the interest of justice and equity. 2. Learned counsel for the respondents submits that during the pendency of the said writ petition, this Court permitted the petitioner to participate in the written examination and the interview was scheduled to be held on 17.02.2023 and 27.02.2023 respectively. The respondents permitted the petitioner to appear in the written examination in terms of the interim order passed by this Court in the instant writ petition. The petitioner participated in the interview scheduled to be held on 27.02.2023. The respondents issued a final selection list to the post of Assistant Professor in Electrical and Electronic Engineering stating that the post is not filled on the ground that no eligible candidates are available. The said final selection list was challenged by the petitioner in - 5 - HC-KAR NC: 2025:KHC:45499 WP No. 3524 of 2023 W.P.No.7052/2023, which is pending for consideration, as the respondents have already published the final selection list. In view of the same, nothing survives for consideration in this writ petition. Accordingly, Writ Petition is dismissed as having become infructuous.
