The petitioner claims to be Member of Matsya Vikas Avam Vipran Federation Limited, Siddharth Nagar. His case is that an auction of fisheries right was held by respondent no. 4, in which lease was given to a private person. The petitioner made a complaint that according to G.O. dated 16.1.2006, co-operative societies whose members are engaged traditionally in fishing, should have been permitted to participate in the initial rounds of auction, and only if none could qualify, that any private person could have participated in the auction. An enquiry was got held by the Commissioner of the Division through SDM, Shohratgarh and Block Development Officer, Shohratgarh and they have submitted their report dated 7.9.2024. It has been forwarded by ADM, Finance & Revenue, Siddharth Nagar to the Commissioner, Basti Region, Basti vide letter dated 16.9.2024, but no action has been taken in the matter so far and hence the instant petition seeking a direction to take decision on basis of the enquiry report. 2. Having heard learned counsel for the petitioner and learned Standing Counsel for the State respondents, we are of the opinion that since enquiry was got conducted by Commissioner and in pursuance whereof, an enquiry report has been submitted, the said proceedings should be taken to its logical conclusion. 3. Accordingly, we dispose of the instant petition with direction to respondent no. 3 to take appropriate decision expeditiously on basis of the enquiry report dated 7.9.2024, after due notice and opportunity of hearing to respondent no. 12, or any other person likely to be affected thereby.
