Learned counsel for the petitioner would submit that the petitioner was legally wedded wife of late Ashadhu Lal. Initially, a decree of divorce was obtained by Late Ashadhu Lal, but subsequently the decree of divorce was set aside. The respondent department is not making payment of family pension to her despite her making various representations. Reference has been made to Annexure No.7, one of which is made to the respondent no.2/the Chief Town and Country Planner, Dehradun, dated 14.06.2024. Learned State Counsel would submit that, in fact, the respondent-Department is proceeding to grant family pension to the petitioner, but there has been some issue raised by the respondent no.3/Rekha Devi. She has already been given a communication to put her claim vide communication dated 19.04.2025, of the respondent department. He would submit that the representation made by the petitioner on 14.06.2024 (Annexure No.7 to the writ petition) shall be decided shortly within a period of 4 weeks. The Court takes on record the statement given by learned counsel for the respondent nos. 2. The writ petition is disposed of with the direction to the respondent no.2/the Chief Town and Country Planner, Dehradun, to decide the representation of the petitioner within a period of 4 weeks from today.
