Page No.# 2/2 Bhattacharjee, learned Government Advocate appearing for the respondents. The case of the petitioner as projected in the writ petition is that, pursuant to the
consideration by the Departmental Promotion Committee, constituted in the Social Welfare Department for promotion to Class-I cadre under the Directorate of Social Welfare Department, Assam, the petitioner was found to be fit for promotion to the post of Deputy Director in the said Department. The petitioner depended upon the minutes of the DPC meeting held on 25.02.2021, to assert her contention that the respondents were required to promote her in accordance with the recommendation. The respondents in the Women and Child Welfare Department, Dispur, Assam have filed affidavit-in-opposition, where they have brought on record an order dated 19th May, 2021, which annulled the minutes of the DPC meeting dated 25.02.2021. The petitioner has not contradicted the contents of the order dated 19.05.2021, by which, the minutes of the meeting of the DPC dated 25.02,2021 were annulled. It is also submitted by the learned counsel for the petitioner that the petitioner has retired from service on attaining the age of superannuation. In view of the specific stand taken by the respondents that the minutes of the DPC meeting on which the petitioner had based her claims has been annulled and also that no person junior to the petitioner had been promoted superseding her during her tenure of service, I do not find any reason to continue with the present writ petition and accordingly, the same stands closed. However, liberty is granted to the petitioner to raise grievance against the order dated 19.05.2021, if so advised. Writ petition stands disposed of. JUDGE Comparing Assistant
