Neutral Citation No. - 2025:AHC:131897-DB Court No. - 29 Case :- WRIT - C No. - 23068 of 2025 Petitioner :- Nanka Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Manoj Kumar Srivastava,Pramod Kumar Srivastava Counsel for Respondent :- A.S.G.I.,C.S.C.,Paras Nath Rai Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. 1. Heard Sri Manoj Kumar Srivastava, learned counsel for the petitioner, Sri Paras Nath Rai, learned Standing Counsel for the State-respondents and perused the material brought on the record. 2. The instant writ petition has been filed under Article 226 of the Constitution of India commanding direction to the respondent-authorities to provide the compensation in favour of the petitioner of Gata No. 219 of 1/6th share of total area 0.6730 hectare situated at Village-Nigaha, Paragana-Atharvan, Tahsil-Manjahnpur, district Kaushambi. 3. Learned counsel for the petitioner submits that the land in question has been acquired by the respondent-authorities without due process of acquisition and even the compensation has not been given to him of the acquired land. Learned counsel for the petitioner, in this backdrop submits, that claim of the petitioner is to be redressed by taking note to the Government Order dated 12.05.2016 by the District Level Committee. 4. Confronted with the above situation, learned counsel for the contesting- respondents very fairly conceded the fact that if the claim as has been set up by the petitioner herein comes within the ambit/scope of Government Order dated 12.05.2016, definitely the same shall be redressed by the District Level Committee. 5. Accordingly, we dispose of the instant petition with liberty to the petitioner to make fresh representation along with true attested copy of the instant order before respondent no.4 within two weeks. In the event, such representation is made, respondent no.4 will transmit the same to the Chairperson of the Committee for being decided in terms of Government Order dated 12.05.2016 by the Committee within next two months after proper survey and opportunity of hearing to the petitioner and all stake holders in the matter.
