The present applicant ‘Jaani’ S/o Jagdish Sagar is praying for bail in relation to First Information Report dated 06.01.2025 bearing FIR No. 10 of 2025 P.S. Rudrapur, District Udham Singh Nagar, wherein, the present applicant along with two others namely Raju and Sandeep Gupta and one unknown person were implicated for the offences punishable under Sections 125(a), 125(b), 3(5) and 105 of BNS, 2023. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and furthermore the applicant have no previous criminal history and the chargesheet has already been filed and as such there is no need of the custodial interrogation of the present applicant. 5. Apart from this, learned counsel for the applicant submits that even as per the prosecution the main role has been assigned to one Rohit and two other co-accused persons Rajkumar Sagar @ Raju and Sandeep Gupta were already enlarged on bail and the same role has been assigned to the present applicant and as such claims parity. 6. On the other side, learned Brief Holder Mrs. Meenakshi Sharma have not disputed this fact that the other co-accused Rajkumar Sagar @ Raju and Sandeep Gupta were already enlarged on bail and the present applicant also assigned the same role and the main accused is Rohit and as such the present applicant is entitled to get the benefit of parity. 7. After hearing the arguments of learned counsel for the parties and further taking into consideration that the other two co-accused Rajkumar Sagar @ Raju and Sandeep Gupta have 2025:UHC:4866 enlarged on bail and the main accused is Rohit and further the chargesheet has already been filed, therefore there is no need of the custodial interrogation of the present applicant, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Jaani’ be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
