This criminal revision petition is filed by the petitioner/accused praying to set aside the judgment dated 10.08.2023 passed in Crl.A.No.44/2022 by the Principal District & Sessions Judge, Davanagere and to set aside the judgment dated 14.06.2022 passed in C.C.No.1354/2018 by the I Additional Civil Judge and JMFC, Harihara. 2. Sri.V.B.Siddaramaiah, learned counsel appearing for the petitioner and Sri.T.Hareesh Bhandary, learned counsel for the accused, are present along with their respective parties. 3
3. It is submitted that the matter has been settled amicably and they have filed an application under Section 320 of Code of Criminal Procedure, 1973, reporting the settlement. The terms of the application reads as under:
"COMPROMISE APPLICATION UNDER SECTION 320 OF CrPC - NOW SECTION 359 OF BHARATIYA NAGARIK SURAKSHA SANHITA (BNSS)
1. The Respondent has filed P.C.R. No.173/2018 on 19.11.2018. The Court of the I Addl. Civil Judge and JMFC, at Harihara, has convicted the petitioner on 14.06.2022, to pay fine of Rs.5,00,000/- (Rs.4,90,000/- to the Complainant towards the Compensation and the remaining fine amount of Rs.10,000/- shall be paid to the State) in default to undergo Simple Imprisonment for 6 months, in CC No.1354/2018. 2. The Learned Principal District & Sessions Judge at Davanagere has dismissed the Crl. Appeal No.44/2022 filed by the Petitioner. The Petitioner has Paid the Fine amount of Rs.10,000/- on 15-06-2022 and deposited Rs.98,000/ on 10-08-2022 in CC No.1354/2018, after filing of criminal appeal. 3. The Petitioner has filed above Revision Petition challenging judgement dated 10.08.2023 passed by the Principal District & Sessions Judge at Davanagere. By the order dated 27.09.2023, this Hon'ble Court has suspended the order of conviction and sentence, subject to deposit 50% of fine amount (including the amount already deposited), before the Trial Court, with 4 weeks. 4. It is submitted that the fine amount is Rs.5,00,000/. In the said amount Rs.4,90,000/- is payable to the Respondent and remaining fine amount of Rs. 10,000/- shall be paid to the State. The Petitioner has made following deposit. 4 Date Amount 15-06-2022 Rs.10,000/- (Fine Amount) 10-08-2022 Rs.98,000/- (Deposit Amount) 25-10-2023 Rs.1,47,000/- (Deposit Amount) Total Rs.2,55,000/-
5. The balance amount payable is Rs.2,45,000/-. The Petitioner and Respondent have amicably settled the dispute on the advice of friends, well- wishers and relatives. The Petitioner will pay balance of Rs.2,45,000/- before this Hon'ble Court at the time of recording compromise. 6.
The Respondent has accepted to receive the balance amount of Rs.2,45,000/- before this Hon'ble Court at the time of recording of compromise. The Respondent has no objection to withdraw the amount Rs.2,45,000/- deposited before the Trail Court. Hence, this compromise Petition. Wherefore, the Petitioner and Respondent pray to set aside the
order of conviction and imprisonment order by the Trial Court and confirmed by the Appellate Court, to meet the ends of justice."
4. The petitioner has paid a sum of Rs.2,45,000/- to the respondent. The respondent, who is present, acknowledges the receipt of the same. The amount deposited before the trial Court i.e., Rs.2,45,000/- shall be refunded to the respondent/complainant. The fine amount of Rs.10,000/- shall be refunded to the petitioner/accused.
5. In view of the above, the judgment dated 10.08.2023 passed by the Principal District & Sessions Judge, Davanagere in Crl.A.No.44/2022
5 confirming the judgment dated 14.06.2022 passed in C.C.No.1354/2018 by the I Additional Civil Judge and JMFC, Harihara are hereby set aside and the petitioner is acquitted from the alleged offences. Accordingly, the petition is
disposed of in terms of the compromise between the parties.
