And 2 Others Counsel for Petitioner :- Sanjeev Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard Shri Sanjeev Kumar Yadav, learned counsel for petitioner and learned Additional Chief Standing Counsel representing State respondents. 2. By means of this petition filed under Article 226 of the Constitution petitioner has assailed the order of suspension dated 06.12.2024 on the ground that long drawn disciplinary proceedings have continued without any final action in the matter and the petitioner has been made to suffer for the suspension order. He further submits that he has been issued with a show cause notice soon after the filing of the present petition before the Court. 3. Learned Standing Counsel on the contrary, submits that since the petitioner is faced with the disciplinary proceedings as he himself admits that he has received a show cause so it would be more appropriate to direct for the conclusion of the disciplinary proceedings in a time bound manner. 4. Accordingly, this petition stands disposed of with direction to the petitioner to first submit reply to the show cause notice within a period of four weeks from today taking all the pleas as available to him against the enquiry report and in the event petitioner furnishes reply as directed hereinabove within the time period as prescribed by this Court, the disciplinary authority shall be taking final decision in the matter within a further period of six weeks. 5.Needless to add that the procedure prescribed under the relevant punishment and appeal rules as well as the principles of natural justice shall be complied with while passing the order by the disciplinary authority. It is further provided that in the event the disciplinary proceedings are not concluded and no final order is passed within the time frame as prescribed by this Court, the order of suspension dated 06.12.2024 shall stand revoked and petitioner shall be reinstated with salary.
