The present bail application has been moved by the applicant accused for the offence punishable under Section 3(1) of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 in Case Crime No.148 of 2024, Police Station Duddhi, District Sonbhadra. 2. Sri Ramesh Kumar Pandey, learned counsel appears for the applicant and submits that only one case has been shown against the accused-applicant in the gang chart, in which he is on bail. In paragraph 11 of the bail application, it has been stated that apart from the case mentioned in the gang-chart the applicant is also involved in one case and in which case, the applicant has been acquitted. As such, he prays that the accused/applicant be enlarged on bail. 3. Learned A.G.A. has opposed the prayer for bail, but conceded that the case shown in the gang chart, the accused/applicant has already been granted bail and one case of criminal history, he has been acquitted. 4. This court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records. 5. The record reveals that only one base case has been mentioned in the gang chart, wherein the accused is on bail and in one case of criminal history, accused has been acquitted. The applicant is in jail since July, 2024. 6. Hence, without touching merit of the case, the bail application is allowed. 7. The accused/applicant- Chandan Kumar be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
