3. It is submitted by the learned counsel for the petitioner that earlier an enquiry was conducted on the application of the petitioner, in which respondent nos. 5 to 7 have been absolved. It is contended that the enquiry was not conducted as per law inasmuch as the Enquiry Committee did not consider the evidence and other material produced by the petitioner. Versus Counsel for Petitioner(s) : Ajay Kumar Pandey, Somendra Kumar Shukla Counsel for Respondent(s) : Ashish Kumar Singh, C.S.C., K.K.Rao Krishnanand Pandey .....Petitioner(s) State Of U.P. And 6 Others .....Respondent(s)
4. Be that as it may, the petitioner has not challenged the earlier enquiry report in the present petition, so the fact as to whether earlier enquiry conducted by the respondent was not in accordance with the procedure contemplated under law or there is some infirmity and irregularity in the enquiry cannot be considered. In the absence of challenge to the earlier enquiry report, this Court cannot issue a direction for re-enquiry since the petitioner has not challenged the earlier enquiry report which is in favour of the respondent nos. 5 to 7. Therefore, we are not inclined to grant any relief as prayed for by the petitioner in the present petition. 5. Consequently, the writ petition is dismissed with no order as to costs.
