Heard the parties.
The petitioner has been made accused in connection with Bhawnathpur P.S. Case No. 205 of 2024, corresponding to S.T. No.24 of 2025, for the offences registered under Section 64 of the B.N.S., 2023, pending in the Court of learned Additional Sessions Judge-II, Nagar Untari, Garhwa. On the pretext of marriage, petitioner is alleged to have established consensual physical relationship with the informant, who is a major lady aged about 22 years. Later on, petitioner refused to marry her.
Learned counsel for the petitioner submitted that there is nothing on record to show that the petitioner, at the very inception of their relationship has obtained consent for physical relationship with the informant by fraud.
In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Nagar Untari, Garhwa, in connection with Bhawnathpur P.S. Case No. 205 of 2024, corresponding to S.T. No.24 of
2025.
