2. Ms. Meenakshi Sharma, learned Brief Holder for the State.
3. Present applicant “Nitin Singh Brijwal, son of Shri Karan Singh Brijwal”, is praying for regular bail in relation to First Information Report dated 04.04.2025 bearing FIR No. 03 of 2025, Police Station – Baluwakot, District – Pithoragarh, wherein present applicant along with three others co-accused have been implicated for the offences punishable under Sections 179, 180 BNS

4. Learned counsel for the applicant submits that present applicant is innocent and has been falsely implicated and alleged recovery of the counterfeit currency amounting to Rs. 7000/- is false and planted one.
5. Apart from this, learned counsel for the applicant submits that other three co-accused Sameer-ul- Rahman, Waseem and Sohaib have already been enlarged on bail by this Court. He has also placed on record copy of the bail order. He further submits that applicant has no previous criminal history.
6. On the other hand, Ms. Meenakshi Sharma, learned Brief Holder has not disputed this fact that the other three co-accused have already been enlarged on bail and applicant has no previous criminal history and she fairly submits that applicant is also entitled to get benefit of parity for grant of bail.
7. After hearing the arguments of learned counsel for the parties and further taking into consideration that the applicant has no previous criminal history and other three co-accused have already been enlarged on bail, therefore, this Court is of the view that applicant deserves for bail.
8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
9. Let the applicant “Nitin Singh Brijwal, son of Shri
Karan Singh Brijwal”, be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
