On 26.06.2025, the petitioner, respondent and their respective counsels are present and said joint memo has been read and recorded on 26.06.2025. The joint memo is signed by the petitioner, respondent and their respective counsels . As per terms of the joint memo, the matter is settled for Rs.2,27,000/- (rupees Two Lakhs Twenty Seven Thousand only) including the amount in deposit, deposited by the petitioner before the trial Court in a sum of Rs.1,27,000/- (rupees One Lakh Twenty Seven Thousand only). - 3 - HC-KAR NC: 2025:KHC:27260 CRL.RP No. 995 of 2022 4. The petitioner has agreed to pay balance amount of Rs.1,00,000/-(rupees One Lakh only) in four installments as under ; i) 20.07.2025 Rs.25,000/- ii) 20.08.2025 Rs.25,000/- iii) 20.09.2025 Rs.25,000/- iv) 20.10.2025 Rs.25,000/- 5. Today, the petitioner, respondent and learned counsel for the respondent are not present. One of the terms in the said joint memo is that in the event of default of payment within the period, the respondent is at liberty to take appropriate legal action against the petitioner. By order dated 26.06.2025, the respondent – complainant has been permitted to withdraw the amount in deposit deposited by the petitioner before the trial Court in a sum of Rs.1,27,000/- (rupees One Lakh Twenty Seven Thousand only). 6. In view of settlement, the offence punishable under Section 138 of the Negotiable Instruments Act, - 4 - HC-KAR NC: 2025:KHC:27260 CRL.RP No. 995 of 2022 1881 is compounded. In view of compounding of the offence, this Criminal Revision Petition is disposed of as the offence is compounded. 7. The respondent –complainant is at liberty to enforce impugned judgment of the trial Court if the petitioner fails to pay the balance amount of Rs.1,00,000/- (rupees One Lakh only) as agreed in four installments.
