1. Ms. Priti Choudhary, learned advocate appears on behalf of petitioner and submits, her client was provisionally selected to be the retail outlet dealer. Drawing attention to page 25 she demonstrates from statement of her client's account, Rs.40,000/- stood debited on 4th March, 2024 but the amount came back to his account the next day on remark, 'transaction failed'. Both the transactions mention 'ppiocl' (abbreviation of the oil company). She then refers to letter dated 8th May, 2024 of the oil company to submit, thereby the oil company accepted the position of 4th March, 2024 to be the last date for payment of the deposit amount. Transaction failure cannot be attributed to her client as an omission, to invoke the guideline for rejecting the provisional allotment. She seeks interference. 2. Mr. Gaurav Kumar Chand, learned advocate, Central Government Counsel appears on behalf of respondent no.1 (Union of India). Mrs. Archana Singh, learned advocate appears on behalf of respondent nos.2 and 3 (the oil company). She submits, petitioner had admitted to deposit beyond time. Transaction failure is of no consequence. In said letter dated 8th May, 2024, apart from
stating petitioner's admission, the relevant clause stood extracted and reproduced. 3. Ms. Choudhary submits, there be direction for the oil company to consider her client's case on representation to be made by him. She reiterates, her client had and still has the money to deposit as would be evident from his bank statement, disclosed. There be direction for his client's representation to be considered. Mrs. Singh submits, if a representation is made, respondent no.3 will duly deal with it. 4. Petitioner will make representation to respondent no.3 within 25th July, 2025. There must be enclosed in the representation, certified copy of this order and demand draft for Rs.40,000/- drawn in favour of the oil company. We make it clear, our direction to tender the deposit will not create any equity in favour of petitioner regarding consideration of the representation.
In event the representation is made as directed, said respondent will proceed to deal with it and inform petitioner the result within two weeks thereafter. 5. The writ petition is disposed of.
