Heard Mr. Ravi Agrawal, learned counsel for the petitioner. 2. The instant petition has been filed for the following relief:- "Commanding learned Prescribed Authority Civil Judge (SD) Muzaffarnagar to decide the petitioner's Execution Suit No. 2 of 2023 Mukesh Kumar Jain Vs. Sandeep in Original PA suit No. 3 of 2019 Mukesh Kumar Jain Vs. Sandeep within specified short period." 3. Counsel for the petitioner submitted that proceeding for execution being suit No. 2 of 2023 is pending since 23.11.2023, as such, appropriate direction be issued for expeditious disposal of the pending proceeding. 4. Copy of the order sheet has been annexed as Annexure No.2 to the petition in order to demonstrate that the case is not proceeding expeditiously. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to Prescribed Authority Civil Judge (SD) Muzaffarnagar to consider and decide the aforementioned execution suit No. 2 of 2023 (Mukesh Kumar Jain Vs. Sandeep) in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
