The first bail application of the applicant has been dismissed as withdrawn vide order dated 19.11.2024 passed in MCRC No.7157 of 2024. While dismissing the first bail application as withdrawn, liberty was granted VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.03.04 15:02:18 +0530 2 to the applicant to repeat his prayer for bail after examination of material witnesses. 2. Learned counsel for the applicant would submit that three witnesses have been examined including the victim and her parents. The applicant is in jail since 13.08.2024 and trial of the case will take its own time. Therefore, he has filed his second bail application. 3. On the other hand, learned counsel for the State opposes. 4. Considering the submissions made by learned counsel for the parties, considering the fact that though liberty was granted to the applicant to repeat his prayer after examination of material witnesses but from perusal of the case diary, it appears that there are other material witnesses with relates to the medical examination of the victim as well as witnesses of her recovery panchnama etc, who are yet to be examined. 5. Since the other material witnesses are yet to be examined, I do not deem it fit to be considered as change in circumstance. 6.
