1. Mr. D.K. Sharma, learned Senior Advocate assisted by Mr. S.S. Patwal,
learned counsel for the applicant.
2. Mr. Pankaj Joshi, learned A.G.A. for the State.
3. Present applicant-Boby Chaudhary @ Laxman Singh is praying for regular bail in relation to FIR dated 05.03.2025, bearing FIR No. 0072 of 2025, registered at P.S. Transit Camp, District U.S. Nagar wherein the applicant has been implicated for the offences punishable under Section 109, 351(2), 3(5) of BNS
2023.

It is submitted by the learned counsel for the applicant that applicant is innocent and has been falsely implicated, and further charge sheet has already been filed and, as such, there is no need of custodial interrogation of the applicant. Apart from this, he submits that other co-accused has already been granted bail by this Court and the applicant claims for parity.

On the other side, Mr. Joshi, learned A.G.A. for the State has not disputed this fact that the applicant is entitled to get parity of Jay Prakash but he submits that role of both the accused persons are slightly different. He further submits that as per the prosecution, the main accused is Suraj Pandey against whom there are sufficient credible evidence on the basis of which charge sheet has been filed.
6. After hearing the arguments of the
learned counsel for the parties and further taking into consideration that the
2025:UHC:5632 main accused is Suraj Pandey against whom evidence has been collected and charge sheet has been filed, and since other co-accused Jay Prakash has been granted bail, therefore, in view of the
submissions as advanced by the learned A.G.A. present applicant is entitled to get parity.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant Boby Chaudhary @ Laxman Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
9. It is made clear that granting bail to the present applicant as well as other co- accused shall not be treated as a precedent since as per prosecution the main accused is “Suraj Pandey”.
