Learned counsel for the petitioners submits that the petitioners are Drafts Man in Irrigation Department. From Drafts Man position, promotion is made to the position of Junior Engineer, but it requires 10 years service in the Drafts Man Cadre. The petitioners have not completed 10 years service as Drafts Man, but the Uttarakhand Government Servants Relaxation in Qualifying Service for Promotion Rules, 2025, enables the competent authority to relax the eligibility in this regard. He submits that , in fact, the respondent no.3/Engineer in Chief, Irrigation Department, made a communication to the respondent no.1/Secretary, State of Uttarakhand, for relaxation in the length of service in the eligibility criteria for promotion from Drafts Man to the Junior Engineer on 13.05.2025, but no decision has yet been taken on it.
Learned counsel for the petitioners submits that the respondent no.1 may be
directed to take a decision on the communication dated 13.05.2025 of the respondent no.3/Engineer in Chief, Irrigation Department, within stipulated time. Learned State Counsel would submit that communication dated 13.05.2025 of the respondent no.3/Engineer in Chief, Irrigation Department, shall be decided within a period of eight weeks.
The Court takes on record the statement given by learned State Counsel. The petition is disposed of with the directions to the respondent no.1 to take a decision on the communication dated 13.05.2025 of the respondent no.3/Engineer in Chief, Irrigation Department (Annexure No.10 to the writ petition), within a period of eight weeks, in accordance with the law/guidelines.
