Neutral Citation No. - 2025:AHC:116960 Court No. - 4 Case :- WRIT - A No. - 9886 of 2025 Petitioner :- Vipendrda Kumar Rathi Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Abhai Singh,Virendra Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard Shri Virendra Singh, learned counsel for petitioner and learned Standing Counsel. 2. By means of this petition filed under Article 226 of the Constitution petitioner has questioned the order of transfer dated 15.06.2025 on the ground that petitioner remained posted only one year in district Hapur and so he could not have been considered for transfer as per transfer policy and secondly he has to appear in so many cases as witnesses where he had conducted raid being in a position of Chief Food Security Officer. It is further contended that the petitioner's wife is ailing as suffering from brain stroke and is currently under treatment at Meerut and at times he also has to take her to AIIMS, New Delhi. He further submits that the respondent no. 3 who has been transferred to petitioner's place has spent only one year's time in aspirational district at Chitrakoot whereas under the relevant transfer policy he was required to stay there at Chitrakoot for at least two years. He has further submitted that in order to accommodate the respondent No. 3 petitioner has been transferred. 3. On the contrary it is submitted by learned Standing Counsel representing State respondents that the respondent no. 3 has been transferred on personal request whereas petitioner has been transferred in administrative exigency and, hence, if petitioner has any grievance he may make a representation before the competent authority who may be directed to decide the same in accordance with law. 4. In the given facts and circumstances, I consider it appropriate for the petitioner to make a representation raising all his grievances and make a requested to be adjusted in a nearby district to Meerut or at a place near to Delhi where petitioner can not only undertake treatment of his ailing wife but also can take her to
AIIMS before the competent authority within two weeks from today. 5. It is further observed that the concerned respondent shall consider the grievance of the petitioner sympathetically and pass appropriate order upon the representation within a short period of time of two weeks of receipt of representation. 6.
This petition thus, stands disposed of. Order Date :- 18.7.2025 Nadeem Digitally signed by :- NADEEM AHMAD High Court of Judicature at Allahabad
