1. The instant petition involves disputed questions of law which cannot be gone into while exercising the writ jurisdiction and when learned counsel for the petitioner was confronted with the maintainability of the instant petition, he submits that he has filed various representations before the competent Authority, but no decision has been taken till date on the said representations.
2. Learned counsel for the petitioner, accordingly, submits that he would feel satisfied if the respondents be directed to treat the instant petition as representation and take decision thereon within some reasonable time frame.
3. On the asking of the Court, Mr. Faheem Nisar Shah, learned GA, has caused appearance on behalf of the respondents and submits that he is not averse to the disposal of the instant petition in the aforesaid manner. However, he further submits that the representation of the petitioner would be considered in accordance with law.
4. With the consent of learned counsel for the parties, the instant petition is taken up for final disposal and is, accordingly, disposed
of by directing the respondents to treat the instant petition as representation and take decision in this regard within a period of four weeks strictly under rules and as per the law from the date a copy of this Order and writ petition along with Annexures enclosed thereto, are made available to the respondents.
5. Disposed of in the aforesaid terms.
