THIS PETITION, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs: "Wherefore, the petitioners most respectfully prayed that this Hon'ble Court may kindly be pleased to: i) Quash the FIR in Crime No.0165/2024 lodged by the first respondent, the South Women Police Station, Vishveshwarapuram Sub Division, Bengalulru city against the petitioners for the alleged offences punishable under Section 498A, 323, 504, 506, 34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act pending on the file of the 37th Additional Chief Metropolitan Magistrate at Bengaluru. ii) Quash the complaint dated 11.12.2024 lodged by the second respondent Smt.Easha Jain, the second respondent herein before the first respondent, the South Women Police Station, Vishveshwarapuram Sub Division, Bengaluru city against the petitioners for the alleged offences punishable under Section 498A, 323, 504, 506, 34 of the Indian Penal Code and - 5 - HC-KAR NC: 2025:KHC:27784 CRL.P No. 14373 of 2024 Section 3 and 4 of the Dowry Prohibition Act pending on the file of the 37th Additional Chief Metropolitan Magistrate at Bengaluru. iii) Pass any other or further orders which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." 2. During pendency of this petition, the respondent No.1 - Police Authority have filed a charge sheet arraigning all the petitioners herein as accused persons in CC No.25260/2025, which is currently pending before the Trial Court and posted on 3.10.2025. 3. The learned counsel for the petitioners, the learned High Court Government Pleader for the respondent No.1 and the respondent No.1/party-in-person jointly submit that the petition may be disposed of for having become infructuous. 4. The learned counsel for the petitioners further submits that the petition may be disposed of reserving liberty to file a fresh petition challenging the charge sheet in accordance with law, and the respondent No.1 - Police Authority may be directed not to take precipitative/coercive action against the petitioners nor arrest the petitioners till the next date of hearing, which is posted on 3.10.2025. - 6 - HC-KAR NC: 2025:KHC:27784 CRL.P No. 14373 of 2024 5. In view of the above facts and circumstances and the learned counsel jointly submit both sides, I deem it appropriate to dispose of this petition reserving liberty as prayed for by the petitioners. 6. It is further directed the respondent No.1 - Police Authority shall not take precipitative/coercive action nor arrest the petitioners till the next date of hearing of CC No.25260/2025, which is posted on 3.10.2025.
