CRM-M-35444-2025 - 1- IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 221 CRM-M-35444-2025 Date of decision: 14.07.2025 HARVINDER SINGH ALIAS DEEPU ....Petitioner Versus STATE OF PUNJAB AND ANOTHER ...Respondent CORAM: HON'BLE MR. JUSTICE SANJAY VASHISTH Present : Mr. Ruhani Chadha, Advocate for the petitioner. Mr. Manjinder Singh Bhullar, DAG, Punjab. SANJAY VASHISTH. J.(Oral) 1. The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioner(s) FIR No. Date Section(s) Police Station District HARVINDER SINGH ALIAS DEEPU 209 24.10.2024 115(2), 118(1), 191(3), 190, 324 (4), 351(2) of BNS (Section 118(2) of BNS added later on) Beas Amritsar Rural 2. Learned counsel for the petitioner reads out the vernacular of the FIR and submits that petitioner is attributed a datar blow on his right leg of injured Ravijot Singh. In fact, there is no injury on the right leg, corroborating the factual allegations mentioned in FIR. Injured Ravijot Singh has suffered total 05 injuries AMANDEEP GOSAIN 2025.07.16 13:47 I attest to the accuracy and integrity of this order/judgment CRM-M-35444-2025 - 2- and 03 of the injuries are already declared simple and injuries No.2 and 4 have been declared grievous. In fact, injury No.2 which is found to be grievous is on the left leg below the knee and injury No.4 is on little finger of left hand of injured Ravijot Singh. 3. Thus, counsel contends that infact, there being no injury on the right leg of injured, his involvement seems to be highly doubtful. Moreover, petitioner has already undergone incarceration period of more than 04 months inside jail, thus prays for grant of regular bail. 4. Learned counsel for the petitioner on examining the facts from record is unable to dispute the factual averment, though submits that may be inadvertently, complainant mentioned it as injury on right leg instead of left leg. 5. Learned State counsel is unable to controvert the submission that petitioner has already suffered incarceration of more than 04 years and the offences are triable by the Court of Magistrate and involvement of the petitioner is still to be established by the prosecution. However, he vehemently submits that if the petitioner is granted concession of bail, there is every likelihood of him being absconding from the trial and again can indulge in similar kind of activities. 7. This Court has heard the learned counsel for the parties concerned, and has also gone through the record before it. 8. As per the totality of circumstances, and the facts/allegations levelled against the petitioner, and the factors noticed hereinabove, I deem it appropriate to grant the concession of bail to the petitioner. Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 9. Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 10. Any of the discussion done and recorded hereabove, shall not be construed as an expression of opinion on the facts of the case. Therefore, trial Court is expected to decide the case by taking an independent view, on the basis of AMANDEEP GOSAIN 2025.07.16 13:47 I attest to the accuracy and integrity of this order/judgment CRM-M-35444-2025 - 3- evidence available on record, as expeditiously as possible, in accordance with law. 11.
