Mr. Rohan Mazumdar, the learned counsel appearing for the appellant at the outset, on instruction, seeks leave of this Court to withdraw the instant First Appeal in view of the fact that a suit for dissolution of marriage being O.S No.602 of 2020 has already been filed before the competent Court of jurisdiction. 2. Mrs. Vani Kumari, the learned counsel on telephonic instruction received from the respondent for filing Vakalatnama on her behalf is present in the Court. 3. Considering the submission made on behalf of the learned counsel appearing for the appellant, leave, as prayed for, is granted. 4. Accordingly, the instant appeal is dismissed as withdrawn and disposed of as such. 5.
