The petitioner has been made accused in connection with Poraiyahat P.S. Case No. 130 of 2024, for the offence registered under Section 70(1) of Bharatiya Nyaya Sanhita, 2023 and Sections 4 & 6 of the POCSO Act, pending in the court of learned Additional District & Sessions Judge-1st class, Godda. On 25.10.2024 at about 8:30 p.m., the daughter of the informant was raped by 15 persons. Statement of the victim was recorded under Section 183 of the B.N.S.S., in which, she has named the petitioner as one of the rapists. Considering the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. (Ambuj Nath, J.) BS/-
