ORAL ORDER
The present writ petition is filed aggrieved by the order passed in M.C.No.51/2025 dated 17.12.2025 by the Principal Judge, Family Court, Chikkaballapura, the husband is before this Court.

Learned counsel appearing for the petitioner submits that the M.C. is filed in the month of April 2025. The petitioner is the husband, who has filed the M.C. The Family Court without giving a reasonable opportunity to the petitioner had passed an order that the matter will be posted for judgment on 18.12.2025 and the petitioner is at liberty to file his written
arguments online by serving the copy on the respondent counsel. The order also discloses that the case again called at 4.00 pm. Both the parties and counsels present. Petitioner counsel filed I.A. U/o XVII Rule 1 R/w Sec. 151 of CPC seeking two weeks time for arguments stating that he wants to challenge order dated 17.12.2025 before High Court of Karnataka, that cannot be a ground to adjourn the matter and another application under Section 151 of CPC to recall the
order. Call on for arguments of the petitioner by 18.12.2025.

3. This Court do not find any reasons to interfere with the order passed by the Family Court. There are clear lapses on the part of the petitioner in prosecuting the matter. The Learned Judge is making the best efforts to see that the matters are disposed of at the earliest. This Court had perused the order sheet and the same reveals that on several occasions, there was no representation on behalf of the petitioner. The petitioner having filed the M.C. should have pursued it diligently. Having observed the order passed by the Learned Judge right from the beginning and the endeavor the Learned Judge is making to dispose of the matter, these kinds of orders cannot be interfered by the High Court. This Court do not find any reasons to interfere. Hence, this Court is passing the following:
ORDER i. Accordingly, the writ petition is dismissed. ii. All I.As., in the writ petition shall stand closed.
