JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed by the husband and his friend seeking quashing of the proceedings pending in C.C. No. 16899/2023, arising out of Crime No. 0152/2022, pending before the VII ACMM, Bangalore, for the offences punishable under Sections 323, 352, 354, 354-A, 354-B, 504, 506 read with Section 34 of IPC. - 3 - HC-KAR NC: 2025:KHC:38602 CRL.P No. 12900 of 2025 2. Petitioner's counsel referring to memorandum of settlement filed under Section 89 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, would point out that the marriage of the 1st petitioner and 2nd respondent is dissolved and in terms of the dissolution of marriage, the husband has agreed to make payment of Rs.9,00,000/- towards full and final settlement. The said amount is already paid by way of demand draft. 3. The 2nd respondent who is present before the Court admits that the marriage is dissolved. She also admits that she has received a sum of Rs.9,00,000/- by way of demand draft which is credited to her account. 4. In view of amicable settlement and the fact that this Court has given a quietus by securing dissolution of marriage and reciprocal payment of permanent alimony to the tune of Rs.9,00,000/-, continuation of the criminal - 4 - HC-KAR NC: 2025:KHC:38602 CRL.P No. 12900 of 2025 proceedings would serve no useful purpose and would amount to an abuse of the process of law. 5. Accordingly, this Court passes the following: ORDER i) The petition is allowed. ii) The proceedings pending in C.C. No. 16899/2023, arising out of Crime No. 0152/2022, pending before the VII ACMM, Bangalore, for the offences punishable under Sections 323, 352, 354, 354-A, 354-B, 504, 506 read with Section 34 of IPC, insofar as they relate to the petitioners, are hereby quashed.
