The petitioner is before this Court seeking for the following relief: "Therefore, it is prayed that this Hon'ble court may be pleased to nominate independent arbitrator to adjudicate the dispute between the petitioner an the respondent in terms of clause - 12, vide annexure - A of the agreement styled as 'agreement for exclusive supply of building stone - QL No.1024' dated 20.01.2022, in the interest of justice." 2. Learned counsel for the respondent fairly submits that two other disputes have already been referred to arbitration. The present dispute may also be referred to the same arbitrator. 3. On enquiry as to who the arbitrator appointed in the earlier cases is, both the counsel submit that Hon'ble - 3 - HC-KAR NC: 2025:KHC:49863 CMP No. 334 of 2025 Justice Sri. John Michael D'Cunha, a former Judge of this Court is the Arbitrator in those cases. Hence, I pass the following: ORDER i) The CMP is allowed. i) Hon'ble Justice Sri. John Michael D'Cunha, a former Judge, of this Court is appointed as sole arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court. ii) Registry is directed to forward a copy of this order to the Director, Arbitration and Conciliation Centre for doing the needful. iii) Since the order is passed in the presence of both the counsel, they shall appear before the Director, Arbitration and Conciliation Centre without requirement of any ii) All contentions are left open. iii) Registry is directed to return the original and/or certified copies, if produced, to the respective parties - 4 - HC-KAR NC: 2025:KHC:49863 CMP No. 334 of 2025 who have produced it/them by following due procedure.
