JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the accused No.1 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.81/2025 of Nazarabad Police Station registered for offences under Sections 126(2), 109, 352, 351(2), 3(5) of BNS. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Learned counsel for petitioner would contend that accused No.2 has been granted bail and accused No.3 has been granted anticipatory bail. There was a previous enmity due to which a false complaint has been registered against the petitioner and others. The investigation is almost completed. The injured has sustained simple injuries. The petitioner is ready to co-operate with the police in further investigation and abide by terms and - 3 - HC-KAR NC: 2025:KHC:43488 CRL.P No. 13929 of 2025 conditions to be imposed by this court. With these he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that serious overt acts are alleged against this petitioner assaulting the injured with knife along with his son and his wife. The petitioner and his son are having criminal antecedents. The injured has sustained lacerated wound measuring 2 cms x 1.5 cms and it has been stitched. The petitioner is having criminal background. Several petitions are filed against him in the police station. Therefore, the petitioner is not entitled to the discretionary relief of anticipatory bail. With these, she sought for dismissal of the petition. 5. Having heard the counsel, the Court has perused FIR, complaint and other materials placed on record. 6. One Nagaraju has given statement when he was taking treatment in the hospital and on the basis of the said statement, a case came to be registered against the - 4 - HC-KAR NC: 2025:KHC:43488 CRL.P No. 13929 of 2025 petitioner and two others in Crime No.81/2025 of Nazarabad Police Station for the aforesaid offences. On perusal of the averments of the complaint in the quarrel between injured and the accused persons, this petitioner/ accused No.1 assaulted the injured with a knife and caused injury. The said averment in the statement of the injured indicate that the petitioner has attempted to commit his murder and as he escaped, it touched his left ear and sustained bleeding injury. The petitioner is alleged to have been involved in criminal activities and the petitions are filed against him in Nazarabad police station. Considering the serious overt act alleged against the petitioner and his criminal background, he is not entitled for grant of discretionary relief of anticipatory bail.
