The following prayers have been made in the instant petition:- "(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent authorities not to demolish the dwelling house of the petitioner constructed on Gate No.384 Ka and 384 Kha situated at Village Mundiya Malukpur Aitmali, Tehsil Munda Pandey, District Moradabad. (ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents not to take any coercive measure except according to the procedure established by law. " 2. The case of the petitioner is that his house exists over the disputed land i.e. Gata No.384 Ka and 384 Kha situated at Village Mundiya Malukpur Aitmali, Tehsil Munda Pandey, District Moradabad. It is alleged that in the year 2009, the said land was illegally recorded in the name of Gram Samaj and later, during the consolidation proceedings, it came to be recorded in the name of Khilafat (respondent No.7) herein. It is also alleged that respondent No.7 is trying to interfere with the possession of the petitioner. 3. The order by which the land was allegedly recorded in the name of Gram Samaj is not under challenge. The consolidation proceedings are also not under challenge. 4. The remedy of the petitioner, if any, was to challenge the aforesaid proceedings. 5. No good ground is made out to examine the aforesaid issues in exercise of writ jurisdiction.The petition is dismissed with liberty to the petitioner to avail such other remedy as may be advised.
