This petition has been filed with the prayer to direct the respondents to take action against respondent nos.5 and 6, who are the Station House Officer and Incharge Out-post Lalganj, who allegedly have demolished petitioner's construction and are helping private respondents in raising construction on the spot. Proceedings under Section 164 B.N.S.S., 2023 have been instituted for preservation of peace on the spot. Such proceedings are pending. Perusal of the records would indicate that there is a dispute with regard to immovable property between the petitioner and the private respondents. Such proceedings can always be got adjudicated by the appropriate civil court. Proceedings under Section 164 B.N.S.S., 2023 would otherwise remain subject to the proceedings to be undertaken by the competent civil court. We are thus not inclined to interfere in the matter only because some photographs show that certain police personnel are present at the spot, particularly when proceedings for breach of peace is found at the spot and the authorities have acted under Section 164 B.N.S.S., 2023. Leaving it open for the petitioner to approach the competent civil court for necessary relief, this petition is consigned to records.
