The petitioner is before this Court seeking for the following reliefs; Appoint a sole Arbitrator to resolve the disputes and outstanding issues between the parties in accordance with the provisions of agreement Bearing No. B/ENHM/SMVB/CLNG/EN 20230 marked as Annexure-B dated: 28.02.2023 arbitration clause 63 & 64 gcc, in accordance with law in the interest of justice and equity. 2. After arguing for sometime, both the counsels submit that an arbitrator could be appointed by leaving all contentions open to be adjudicated by the learned arbitrator, so appointed. 3. A memo has been filed by learned counsel for respondents enclosing a list of retired officers of the Railway Board who are empaneled as arbitrators.
