Heard the learned counsel appearing for the petitioners and learned counsel appearing for the respondents. Perused the material on record. 3. The petitioners have approached this Court seeking a Writ of mandamus directing respondents-BDA to implement the Sub Committee resolution dated 28.08.2023 along with cover note dated 10.11.2023 at Annexures-J and K and consider the representation dated 19.06.2025 at Annexure-L. 4. Learned counsel for the petitioners submits that the respondent-BDA had implemented a scheme to grant incentive sites to persons whose lands were acquired by the BDA. Accordingly, the petitioners were entitled for 2 sites measuring 30X40 feet and 20X30 feet under the Incentive Scheme for Voluntary Surrender of Land Rules, - 4 - HC-KAR NC: 2025:KHC:41343 WP No. 31180 of 2025 1989 ('Rules' for short). It is submitted that the petitioners' land was acquired in the year 1991, and that the Sub Committee of the BDA passed a resolution on 28.08.2023 to allot two such sites in favour of the petitioners. However, till date, the respondents have not allotted the said sites. In these circumstances, the petitioners seek a direction to implement the resolution at Annexures-J and K and to consider the representation submitted at Annexure-L. 5. Per contra, learned counsel appearing for respondents-BDA fairly submits that the petitioners’ representation would be considered within a reasonable time, in accordance with law. 6. From the material on records, it is evident that the Sub Committee by resolution dated 28.08.2023 at Annexure-J, resolved to allot two sites to the petitioners. It further emerges that the Sub Committee's decision was in consonance with resolution No.33/2018 - 6 - HC-KAR NC: 2025:KHC:41343 WP No. 31180 of 2025 dated 05.03.2018 (Annexure-H) and the corresponding cover note at Annexure-K dated 10.11.2023. The petitioners have reiterated these facts in their representation at Annexure-L. Hence, the grievance of the petitioners would be sufficiently addressed, if an appropriate direction is issued to the respondents to consider the representation, keeping in mind, the Sub Committee resolution dated 28.08.2023 and the cover note dated 10.11.2023. Hence, this Court pass the following; ORDER. i) The writ petition is allowed. ii) Respondent No.3 is directed to consider the representation of the petitioners at Annexure-L dated 19.06.2025, in light of the Sub Committee resolution dated 28.08.2023 and the cover note dated 10.11.2023 and to pass appropriate orders - 7 - HC-KAR NC: 2025:KHC:41343 WP No. 31180 of 2025 in accordance with law within an outer limit of three(3) months from the date of receipt of a copy of this order.
