3. Learned counsel for the applicant submits that applicant is a lady and she has been made accused in four cases, investigation of which is being conducted by CBI and in all the four cases bail granting orders have been passed in her favour with the direction that she will file personal bonds and two sureties for each cases but applicant is not in a position to provide two sureties for each cases, i.e., total eight sureties, therefore, in spite of bail granting
order passed in her favour, she is still remain in jail and, therefore, she may be permitted to file common sureties in all the four cases so as she may be released on bail pursuant to the bail granting orders passed in her favour. 4. Sri Rahul Srivastava, learned counsel appearing for the CBI, however, submits that there is no such provision under either Cr.P.C. or BNSS, which enables the applicant to file common sureties in all the four cases but he further submits that this Court, in the interest of justice, considering the financial status of the applicant, can permit her to file personal bail bonds and two common sureties in all the four cases. 5. I have heard learned counsel for the parties and perused the record of the case. 6. From the record it reflects that applicant, who is lady, has been made accused in following four cases:- i) RC no.1202021(A)0006, U/120 B read with 420, 471 IPC and 13(2)read with Section 13(1)(d) P.C.Act, P.S.-CBI, A.C.B., District Ghaziabad. (ii) RC no.0072022(A)0002, U/s 120B read with 420, 468, 471 IPC, and 13(2) read with section 13(1)(d) P.C.Act, P.S.-CBI, ACB, District Ghaziabad. (iii) RC no.120 2021(A)0005, U/s 120B read with 420, 471 IPC, and 13(2) read with section 13(1)(d) P.C. Act, PS CBI, ACB, District Ghaziabad. (iv) RC no.120 2022 (A)0001, U/s 120B read with 420 IPC and 13(2)read with Section 13(1)(d) P.C.Act, PS-CBI, ACB, District Ghaziabad. 7. It further reflects, in all above four cases bail granting orders have been passed in favour of applicant but she is still in jail as according to applicant she is not in a position to furnish two separate sureties for each four cases and court concerned directed her to furnish two sureties for each cases. 8. As in favour of applicant bail granting orders have been passed in all the aforementioned four cases and only due to the reason that she is not in a position to provide two separate sureties in each four cases, she is still in jail, therefore, considering the Article 21 of the Constitution of India, in view of this Court, in the interest of justice, she may be permitted to file common sureties in all the four cases. 9.
Therefore, the instant application filed by applicant is allowed and it is directed that if applicant furnishes two sureties then both the sureties shall hold good for all the aforementioned four cases.
